Amendment C58sgra

The Southern Grampians Shire Council has prepared Amendment C58sgra to the Southern Grampians Planning Scheme.

The Amendment applies to land within and around the Township of Coleraine, as identified within the Coleraine Flood Investigation 2018.

Specific details of land affected by the new controls and modifications to existing flood controls are shown on maps that form part of the amendment. Please contact Council on 03 5573 0256 for more details.

Why is the Amendment required?

The Amendment is required to implement the findings of the Coleraine Flood Investigation 2018 by updating the local planning policy relating to flooding and applying updated flood overlays to areas in and around the township of Coleraine known to be affected by mainstream flooding during a 100 year ARI (average recurrence interval) flood.

The Flood Overlay (FO) is applied to areas that are likely to convey active flood flows and/or store floodwaters to hazardous depths. The Land Subject to Inundation Overlay (LSIO) is applied to areas that are subject to mainstream flooding but have a lower flood risk than areas in the FO.

The Amendment introduces New Schedules to the FO and LSIO overlays containing detailed permit requirement provisions; and introduces an incorporated document: Hamilton and Coleraine Local Floodplain Development Plan 2020.

Specifically the Amendment:

In Overlays - Clause 44.03, insert a new Schedule 1 in the form of the attached document.
In Overlays - Clause 44.04, insert a new Schedule 1 in the form of the attached document.
In Overlays - Clause 44.04, replace the existing Schedule with a new Schedule 2 in the form of the attached document.
In Operational Provisions - Clause 72.03, replace the Schedule with a new Schedule in the form of the attached document.
In Operational Provisions - Clause 72.04, replace the Schedule with a new Schedule in the form of the attached document.

Council considered the amendment at its 9 Dec 2020 Ordinary Council Meeting and the following motion was carried:

That Council:

1. Pursuant to section 22 (1) of the Planning and Environment Act 1987, consider all submissions received to Southern Grampians Amendment C58sgra.

2. Pursuant to section 23 (1)(a) of the Planning and Environment Act 1987, make changes to Amendment C58sgra to remove the Floodway Overlay from 66 Whyte Street, Coleraine affected by very minor encroachments at the extremity of the flood mapping extent as detailed within the report.

3. Pursuant to section 23 (1) (b) of the Planning and Environment Act 1987, refer the unresolved submission to an Independent Panel.

4. Authorise officers/suitable persons to represent Council at the Planning Panel hearing generally in accordance with the response to issues outlined in this report.

The Council report included discussion of all submissions received.

In accordance with clause 4(2) of Ministerial Direction No. 15 the following panel hearing dates have been set for this amendment:

Directions hearing on Friday 25 January 2021 at 10.00 am.
Panel hearing on 22 of Monday 22 February 2021.

Planning Panels Victoria Directions Hearing

The Hearing previously scheduled for 22 February 2021 will not be held. The Panel will proceed to report on the Amendment on the basis of submissions made.
